Quotation Terms and Conditions
These terms govern quotation requests submitted through the Waray Solar website. By checking the acceptance box or continuing the quotation workflow, the customer confirms that they have read, understood, and accepted these terms for the quotation request.
1. Non-binding quotation
The online quotation is an estimate prepared from information supplied by the customer, including energy usage, selected coverage, battery support, location, roof information, and preferred project details. It is not a final proposal, installation contract, engineering design, financing approval, utility approval, or promise to install.
Waray Solar may accept, reject, revise, or withdraw a quotation request after review. No installation obligation exists unless both parties later sign a separate written agreement approved by Waray Solar.
2. Review conditions
Any quotation remains subject to electricity bill verification, site inspection, roof and structural review, electrical review, utility requirements, permitting requirements, safety checks, equipment availability, and any conditions discovered before or during project review.
The customer is responsible for providing complete and accurate information. Waray Solar may rely on the information submitted and is not responsible for errors, delays, added costs, or unsuitable recommendations caused by inaccurate, incomplete, outdated, or misleading information.
3. Price, taxes, and exclusions
Displayed pricing is based on current assumptions at the time of submission and may change because of site conditions, customer changes, supplier pricing, foreign exchange movement, freight, taxes, permits, utility charges, or equipment availability.
Unless a later signed agreement states otherwise, the quotation excludes structural repairs, roof replacement or waterproofing, service entrance upgrades, utility interconnection fees, permit fees, trenching, long cable runs, civil works, relocation of obstructions, hazardous material handling, generator integration, internet or monitoring subscriptions, and other work outside the quoted scope.
4. Deposit and payment handling
The required deposit or processing payment shown in the workflow is collected to continue the quotation or signed-quotation process. It may be credited toward a later installation agreement with Waray Solar if the customer proceeds and the later agreement allows the credit.
Payment of a deposit does not guarantee final pricing, project acceptance, installation schedule, equipment reservation, government incentive approval, financing approval, or utility approval. Waray Solar may deduct non-recoverable costs, payment gateway fees, document preparation costs, site assessment costs, supplier charges, or other third-party costs already incurred before refunding any refundable balance, to the maximum extent allowed by law.
5. Customer authority and access
The customer represents that they are the property owner or are authorized by the property owner to request a quotation and site review. The customer must provide safe and reasonable site access, disclose known property defects, disclose roof leaks or structural concerns, and secure any landlord, association, business, or occupant permissions needed for review.
6. Permits, utility approval, and third parties
Permits, utility interconnection, net metering, inspections, financing, incentives, and other third-party approvals are controlled by the applicable third party and are not guaranteed by Waray Solar. Delays, denials, additional requirements, or fees from third parties may change the project price, scope, or schedule.
7. Equipment substitutions
Waray Solar may recommend or use equivalent or better substitute equipment if originally quoted items are unavailable, delayed, discontinued, unsafe, incompatible, or commercially impractical. Final equipment brands, models, specifications, and warranties will be confirmed in the later written proposal or installation agreement.
8. Timelines and force majeure
Any timeline discussed during the quotation process is an estimate only. Waray Solar is not liable for delays caused by weather, utility action, permitting, supplier delay, shipping delay, labor interruption, illness, accident, government action, power interruption, payment delay, customer inaction, site inaccessibility, force majeure, or other events outside Waray Solar's reasonable control.
9. Warranties and performance estimates
Product warranties are provided by the applicable manufacturers and are subject to the manufacturers' terms. System performance, savings, battery runtime, payback, and bill reduction figures are estimates only and may vary based on weather, shading, equipment behavior, utility rates, load changes, maintenance, customer usage, and grid conditions.
Except for warranties expressly stated in a later signed agreement, Waray Solar disclaims all other warranties to the maximum extent allowed by law. Nothing in these terms limits rights that cannot legally be waived.
10. Customer changes and cancellation
Customer-requested changes, delayed responses, missed appointments, changed site access, changed load requirements, or changed equipment preferences may require a revised price, revised deposit, revised schedule, or cancellation of the request. Waray Solar may cancel a quotation request if the project is unsafe, impractical, uneconomical, outside service coverage, unsupported by required documents, or otherwise unsuitable after review.
11. Limitation of liability
To the maximum extent allowed by law, Waray Solar will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost savings, lost income, lost business, loss of use, data loss, or utility charges arising from a quotation request. Waray Solar's aggregate liability for the quotation workflow will not exceed the amount actually paid by the customer to Waray Solar for that quotation workflow, except where a higher amount is required by mandatory law.
12. Customer indemnity
The customer agrees to hold Waray Solar harmless from claims, losses, costs, penalties, or expenses arising from inaccurate customer information, lack of property authority, unsafe site conditions not disclosed to Waray Solar, denial of required access, third-party property claims, or customer misuse of quotation materials, to the maximum extent allowed by law.
13. Data use and electronic records
Waray Solar may use submitted information to prepare quotations, contact the customer, verify project details, process payments, maintain records, generate documents, deliver customer support, comply with legal or accounting duties, and improve internal operations. Waray Solar may keep electronic records of the accepted terms version, date and time, displayed quote amount, displayed deposit amount, IP address, user agent, payment records, and workflow history.
14. Governing law and disputes
These quotation terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. The parties will first try to resolve disputes in good faith. If a dispute cannot be resolved, it may be brought before the proper courts or agencies with jurisdiction under applicable Philippine law.
15. Changes to these terms
Waray Solar may update these quotation terms for future requests. The terms version displayed and accepted at the time of the customer's request will be recorded for that request. If any provision is found unenforceable, the remaining provisions remain effective to the maximum extent allowed by law.
